Terms of service
These terms apply when an eye centre uses Visus, and to anyone using this website. Each centre also receives a written order setting out its modules, number of users, price and start date. Where the order and these terms differ, the order wins.
1. Who we are
Visus is made and provided by AppBay, Palestine (info@appbay.dev, +970 59 757 9694). "The centre" means the eye centre, clinic or practice that has ordered Visus, and "staff" means the people the centre gives accounts to.
2. The service
- Visus is provided as a hosted service: AppBay runs it on its servers and the centre uses it through a web browser. Nothing is installed at the centre except, where a device needs it, a small program on that device's computer to send its reports to Visus.
- Setting up, importing existing data and training are provided as described in the order.
- Updates and improvements are included. We may change how a feature works; we will not remove a feature the centre relies on without telling it first.
- AI features, text messages and spoken patient calls are optional, depend on outside providers, and may carry usage costs set out in the order.
3. Availability and support
We aim to keep Visus available every day and to do maintenance outside the centre's working hours, announcing anything that will interrupt work. Like any online service it depends on the internet, including the centre's own connection, and outages can happen; we work to restore service as quickly as possible. Support is by phone, WhatsApp and email during working hours, and any response times agreed are set out in the order.
4. The centre's responsibilities
- Giving accounts only to its own staff, choosing their roles, and keeping passwords private. Each person uses their own account.
- The accuracy of what is entered, and having a lawful basis and any consent needed to record and process its patients' information, under the laws that apply to it.
- Its own computers, devices, printers and internet connection.
- Telling us promptly about a fault, or about any access to Visus it did not authorise.
5. Clinical responsibility
Visus records, organises and presents information. It does not examine, diagnose, prescribe or decide treatment, and nothing it shows replaces a clinician's judgement. Clinical decisions stay with the centre's licensed staff, who must check what they sign and print, including prescriptions, doses and calculations. Text produced by dictation or by an AI feature is a draft: it can mishear or be wrong, and must be read and corrected by the clinician before it is saved or relied on.
6. Fees and payment
Fees, what they cover and when they are due are set out in the order. If an invoice is not paid within 30 days of a reminder, we may suspend access after a further written notice. Suspension never deletes data: everything is restored as soon as the account is settled. Prices for a new subscription period may change with at least 30 days' notice before it starts.
7. Data
The centre owns its data, including its patient records. We keep and process it only to provide Visus, as described in the privacy policy. The centre can ask for a complete copy of its data at any time.
8. Fair use
Visus must not be used for anything unlawful, to store data the centre has no right to hold, or to try to get around its security, reach another centre's data, or overload it. Accounts must not be shared or sold on.
9. Ownership of the software
The Visus software, its design and documentation belong to AppBay. The centre receives the right to use Visus for its own work while its subscription runs. The centre's data, name and logo remain the centre's.
10. Liability
We provide Visus with reasonable skill and care. As far as the law allows, AppBay is not liable for indirect or consequential losses, such as lost profits or lost business, nor for clinical decisions made by the centre's staff. Our total liability in any 12-month period is limited to the fees the centre paid us for Visus in that period. Nothing in these terms limits liability that by law cannot be limited.
11. Ending the service
The subscription runs for the period in the order and renews unless either side gives written notice at least 30 days before the end of the period. Either side may end it straight away if the other seriously breaks these terms and does not put it right within 30 days of being told. When the service ends, the centre can have a complete copy of its data during the following 90 days, after which it is deleted as described in the privacy policy.
12. This website
This website describes Visus. The screens shown on it come from a demonstration eye centre, and every name on them is a placeholder. Features and figures described here are for information; what a centre receives is set out in its order.
13. Changes and law
We may update these terms. The date at the top shows the latest version, and centres using Visus are told at least 30 days before an important change takes effect. These terms are governed by the laws in force in Palestine, and disputes go to its competent courts, after we have first tried to settle them together in good faith.
